PPP believes in restoration of deposed judged : Farooq Naek |

ISLAMABAD,
Aug 28 (APP): Minister for Law and Justice Farooq H. Naek Thursday said that the
PPP leadership has always been saying that it believes in restoration and
reappointment of deposed judges.
Talking to
a private television channel, the Minister said that stakeholders, rather than
politicizing this purely a technical issue, should assist the government in
finding an amicable solution in this regard.
He said the
government was sincere in all the commitments that it made for the restoration
of deposed judges but there were some legal matters involved in this process
which ought to be addressed prior to a decision in this regard.
He said the
Constitution is silent with regard to restoration of deposed judges.
The
Minister said that after withdrawal of November 3 PCO on December 15, the
sitting judges of the Supreme Courts including Chief Justice Abdul Hameed Dogar
took the oath under Schedule 3 of the Constitution.
Now the
situation on ground is that, in the presence of one Chief Justice, how can
another one be appointed.
Such are
the legal issues which ask for deliberation from all the stakholders, the
Minister said.
He said the
government does not want to create an environment of confrontation within the
institutions by making the hasty decisions.
The
Minister said that the deposed judges who want to come back to their offices,
would be welcomed.
He said the
Sindh High Court judges who have recently taken the oath of their office have
done so willingly and they were not forced to do so.
To a
question, he said that the parliament has neither validated the November 3 act
of General ® Pervez Musharraf nor it intends to do so. So there is no question
of validation of this step if the deposed judges take fresh oath, he added.
Naek said
that parliamentary resolutions are just the formal requests which are rarely
implemented.
If a
resolution is passed by the parliament with regard to restoration of deposed
judges how it would be implemented, he asked.
So the
conditions on ground require to pursue a constitutional and legal process to
avoid problems in this regard, he said.
He
expressed the hope that PMLN would come back in the coalition in the days to
come.
Responding
to another question, the Minister said that all the cases against Mohtarma
Benazir Bhutto and Asif Ali Zardari were fabricated and despite spending huge
amount from the public kitty the prosecutors could not prove any thing against
them.
