SC seeks Sindh govt response over ECNEC decision regarding Nai Guj Dam case

ISLAMABAD, Apr 10 (APP):The Supreme Court on Wednesday directed the Sindh government to submit its response over decision of the Executive Committee of the National Economic Council (ECNEC) regarding construction of Nai Guj dam.
A three-member bench of the court headed by Justice Sheikh Azmat Saeed and comprising Justice Faisal Arab and Justice Ijaz Ul Ahsan heard the case.
During the course of proceedings, Justice Azmat Saeed asked whether the construction of Nai Guj Dam had been completed.
The Additional Advocate General Sindh informed the court that the provincial government of Sindh had refused to accept ECNEC decision regarding construction of Nai Guj Dam.
He said that the provincial government had stated that they could not pay 50 percent construction cost of the dam.
He said that the provincial government had agreed the proposal of Water and Power Development Authority (WAPDA) regarding construction of dam.
Justice Azmat Saeed remarked that the ECNEC did not approve WAPDA’s proposal.
He observed it seemed that there was a misunderstanding between two units of the federation over the matter of Nai Guj Dam.
The Deputy Attorney General said that the Sindh government had to pay 50 percent of the additional amount.
He said the Sindh government had to pay Rs 10 billion out of Rs 46 billions.
Justice Azmat Saeed remarked that ECNEC was a constitutional forum whose respect was mandatory.
He remarked that the court referred the matter to the ECNEC.
The Additional Advocate General Sindh said that the court could pay amount for construction of dam from the amount which it collected from the Bahria Town.
Justice Azmat Saeed remarked that the court would not pay the amount it collected from Bahria Town.
Later hearing of the case was adjourned till first week of May.
