SC dismisses bail plea of accused in narcotics case

ISLAMABAD, Dec 24 (APP): The Supreme Court of Pakistan on Wednesday heard a bail petition filed by Waleed, who was arrested on charges of possessing narcotics, and dismissed the plea.
The hearing was conducted by a two-member bench headed by Justice Naeem Akhtar Afghan. During the proceedings, the court observed that the bail petition had been withdrawn and was therefore dismissed.
Justice Naeem Akhtar Afghan remarked that the accused was arrested in September this year and questioned how he had approached the Supreme Court so quickly. He observed that if there was any mala fide on the part of the police, the accused must clearly identify it.
Counsel for the accused argued that during a domestic dispute, the police arrested Waleed and subsequently registered a narcotics case against him. At this, Justice Naeem Akhtar Afghan questioned how the police arrived at the scene of a domestic dispute.
Justice Ishtiaq Ibrahim remarked that how a domestic dispute could become so serious that heroin was allegedly planted, while Justice Naeem Akhtar Afghan questioned who would place one kilogram of heroin during a domestic quarrel.
The court was informed that a case had been registered against the accused for the recovery of one kilogram of heroin and 120 grams of ice (crystal meth). The defence counsel further argued that there was no private witness to the incident and no video was recorded at the time of arrest.
Justice Naeem Akhtar Afghan observed that such arguments were relevant for trial proceedings, not for a bail hearing. The court directed the police to submit the challan before the next hearing and instructed the trial court to conclude the trial against the accused at the earliest. It is pertinent to note that Islamabad police had registered the case against accused Waleed in September this year.
