ISLAMABAD, Nov 17 (APP): The Federal Constitutional Court (FCC) on Monday issued a stay order against the decision of Peshawar High Court (PHC) in which it removed the condition of the submission of security by the private institution in cases related to labors’ dues.
The court also served notices to respondents and sought comments on next hearing. A restraining order has been issued on the appeal of the Pakhtunkhwa government.
At the outset of hearing, Justice Hassan Azhar Rizi said where will the poor laborer get so much money in the form of security deposit?
Advocate General KPK Shah Faisal argued that this case is related to poor laborers. The law is that if a private institution fires a laborer, it will pay his dues.
He said that if the private institution does not pay the dues, the laborer can appeal to the relevant department. If the decision is in favor of the laborer, the private institution will deposit the dues in the form of security in the appeal, he added.
The advocate general said that the Peshawar High Court has removed the condition of the security deposit with the appeal of the private institution.
He said that the court should suspend the PHC decision and also issue a restraining order.
After the arguments, the Constitutional Court has issued a restraining order on the decision.
