KPIC decides action against public bodies obstructing access to information

PESHAWAR, Jan 15 (APP):The KP Information Commission (KPIC) comprising of the Chief Information Commissioner, Farah Hamid Khan, Information Commissioners Arshad Ahmed and Muhammad Irshad took serious notice of non- compliance of the Commission orders.
The Commission agreed to issue show cause notices and warning letters to the defaulting Public Bodies including Higher Education Regulatory Authority and AIG Legal (Police Department) in hearings of the complainants.
Muhammad Ayaz resident of District Peshawar filed a complaint(Complaint no 6442) under RTI Act 2013 to the Commission against the WSSP Peshawar wherein he had sought information regarding the appointment details of Tube Well Operators from the Public Information officer/ Manager, WSSP.
The Commission directed the PIO WSSP to proactively disclose all the 12 categories of information of the WSSP Peshawar as mandated in the Section 5 of the KP RTI Act 2013 on the official website of the WSSP besides this, Manager HR WSSP will be summoned in the subject case for providing timely information to the complainant and enhance public trust in the government institutions.
Adjudicating another complaint no 11613 of Faheem Azam, who had filed a complaint with the Commission against Soil & Water Conservation Department Mardan. Wherein he had requested for provision of all the developmental works since January 2017 till date. The department denied the information by stating that they don’t have developmental funds except staff salaries.  The PIO/Director Soil and Conservation Department Mardan was directed to provide para-wize reply to the requester within a week time positively with proper intimation to the Commission.
The Commission took serious notice of absence of AIG Legal and deputing a Sub Inspector in complaints no 11650 and 11654. The Commission ordered that the AIG Legal should be present in the upcoming proceedings along with the relevant record on 16-01-2025.
Deciding a complaint no 11675, filed by Muhammad Iqbal who had sought information about the leasing documents, technical evaluation of Hamala Rest House Nathia Gali owned by the Culture and Tourism Authority.
The PIO/ Deputy Director MIS, Mahad Husnain informed the Commission that  information is uploaded on the Culture and Tourism Authority website,while the missing data shall be updated with in a week time with proper intimation to the KPIC.
Deciding the complaint no 11441, filed by Noor-Ul-Basar, the Commission will write to the Secretary Local Council Board(LCB) to take disciplinary action against the Accounts Section of the LCB over non-cooperation with the PIO / Admin Officer LCB in provision of data so as to meet the objective of transparency in the province.
