Foreigners repatriation case sent to SC judges committee

ISLAMABAD, Dec 13 (APP): The Supreme Court (SC) on Wednesday sent the case pertaining to the repatriation of foreigners to the judges committee for the formation of a larger bench.

The three-member SC bench headed by Justice Sardar Tariq Masood, while hearing the case, observed that the petitioners had objected on the powers of caretaker government under Article 224 of the Constitution.

It said that in the matter of repatriation of foreigners, the interpretation of articles 9, 10 and 24 was required, and it was sending it to the judges committee under the SC (Practice & Procedure) Act for the formation a larger bench.

During hearing, the Federal Government and the Foreign Office submitted their comments.

The case was then adjourned till after the winter vacations.

WaterAid unveils strategy to accelerate progress in WASH initiatives

ISLAMABAD, Dec 13 (APP):WaterAid Pakistan on Wednesday unveiled its ambitious Country Programme Strategy for the period 2023–2028, with a focus on accelerating progress in Water, Sanitation, and Hygiene (WASH) initiatives across the country.
The strategy aims to prioritize the integration of WASH within the health sector, intending to make substantial contributions to public health outcomes said a news release.
The launch event gathered a diverse group of stakeholders, including representatives from academia, community-based organizations, and the media, according to a press release.
Notable attendees included Senator Ms. Sitara Ayaz, Secretary-General of the International Parliamentarian Congress, and Seemee Azdi, Chairperson of the Climate Change Committee.
During the event, discussions were led by key figures such as Dr. Hifza Rasheed, Director-General of PCRWR; Liaqat Ali, Executive Coordinator of the Doaba Foundation; Muhammad Nawaz, Climate Integration Lead at USAID Pakistan; Muhammad Rafiq, Head of the Center for Water Informatics and Climate Resilience at IM Sciences, Peshawar; and Sehr Afsheen, Country Representative of VSO. They explored the crucial roles of stakeholders, academia, and civil societies in enhancing WASH conditions in Pakistan.
Muhammad Fazal, Head of Program Strategy and Policy at WaterAid, concluded the discussions by emphasizing a commitment to collaborative efforts. He called for collective action from stakeholders, academia, development agencies, government ministries, and parliamentarians to mainstream access to WASH in all policies and plans.
Arif Jabbar Khan, Country Director of WaterAid Pakistan, expressed gratitude to all participants and reiterated the organization’s dedication to working closely with local communities, government bodies, and organizations to ensure universal access to clean water and sanitation.

China rejects Indian Supreme Court’s verdict on Ladakh

BEIJING, Dec 13 (APP):: “China has never recognized the so-called union territory of Ladakh set up unilaterally and illegally by India,” Chinese Foreign Ministry Spokesperson Mao Ning said on Wednesday.

“India’s domestic judicial verdict does not change the fact that the western section of the China-India border has always belonged to China,” she told the media while strongly rejecting the Indian Supreme Court’s verdict endorsing the India’s Bharatiya Janata Party-led government’s decision to abrogate Article 370 of the Indian Constitution.

On December 11, the Supreme Court of India announced a verdict, upholding the validity of the order abrogating Article 370 of Constitution, asking the Indian government to restore the statehood in Union Territory of Jammu and Kashmir at the earliest, and upholding the validity of the decision of the Indian government in 2019 to carve out the so-called union territory of Ladakh.

While strongly criticizing the Indian top court’s decision to revoke the special status of Kashmir region, Mao Ning had already said, “On the Kashmir issue, China’s position is consistent and clear-cut. This is a dispute left from the past between India and Pakistan and it should be properly addressed in peaceful means according to the United Nations Charter, UN Security Council resolutions and relevant bilateral agreements.”

It may be mentioned that on August 5, 2019, New Delhi revoked the special status granted to the region under Articles 370 and 35A of the Indian Constitution and downgraded the erstwhile state into two federally-administered Union Territory of Jammu and Kashmir, and Union Territory of Ladakh.

Beijing had objected to the changes to Jammu and Kashmir as China has border claims in Ladakh along what is called as Line of Actual Control.

SC decides to hear all lifetime disqualification cases together

ISLAMABAD, Dec 13 (APP): The Supreme Court (SC) has decided to hear all identical cases pertaining to lifetime disqualification under Article 62(1)(f) of the Constitution together.

These cases, and any others involving the same question, should be fixed for hearing in early January, 2024 before a bench constituted by the committee under the Act, the court said in its written order pertaining to the hearing of an appeal of JUI-F’s former MPA Meer Badshah Qaisrani against his lifetime disqualification.

The apex court said that the general elections of 2008 required candidates to have a minimum graduation qualification. Some candidates made misdeclarations in their requisite nomination papers, some produced degrees from unrecognized institutions and others fake degrees to show eligibility of their participation in the general elections. This court had disqualified all such candidates and some also faced criminal prosecution.

It said that the petitioner was convicted for a period of two years, and “we are informed that his appeal against conviction is pending before the Multan Bench of the Lahore High Court.

“However, the learned counsel for the respondent states that the period of disqualification is for five years as per section 232(2) of the Elections Act, 2017, which provision was enacted through the Elections (Amendment) Act, 2023, promulgated on 26 June 2023.

“The learned counsel are unanimous in stating that unless there is a clear pronouncement by this court on the matter the returning officers in the forthcoming general elections may wonder whether to apply section 232(2) of the Elections Act, 2017, or the said judgment of this court, which may create needless confusion in the elections and shall not be conducive to democracy. There is also the likelihood of election tribunals and courts being inundated with cases arising out of the uncertainty.”

The order said that the Additional Attorney General (AAG) pointed out that in the matters where constitutional interpretation is required a bench of a minimum of five judges has to hear it.

“The AAG also states that the interpretation of a federal law, the Constitution and applicability of the decision of the Supreme Court is required, which will also impact elections to the provincial assemblies, and as such requisite notices be issued,” it added.

The court directed to issue notices to the Attorney-General for Pakistan and all the Advocate Generals of the provinces, besides the Election Commission of Pakistan, which should be published in a prominent English and Urdu newspaper having wide circulation as the decision in these appeals may also affect those who are not parties hereto.

China always played key role in development, stability of Pakistan: Mayor Karachi

KARACHI, Dec 13 (APP): Mayor Karachi Barrister Murtaza Wahab Wednesday said the People’s Republic of China always played a key role in the development and stability of Pakistan.

He said this while addressing the opening ceremony of the open-air gym established with the cooperation of China at the Pakistan-China Friendship Park on Kashmir Road.

He said that the people of Karachi express their gratitude to the Chinese government for the establishment and provision of modern facilities for the citizens at the Pak-China Friendship Park.

On this occasion, China’s Consul General Yang Yundong, People’s Party District Central General Secretary Dil Muhammad, Director General Parks and Horticulture Junaidullah Khan, Deputy Commissioner East Altaf Sheikh and heads of various departments of KMC were also present.

Mayor Karachi along with Consul General of China officially inaugurated the open air gym in Pak China Friendship Park while on this occasion cake was also cut regarding Pak China friendship.

The MoU for cooperation between Chinese Consulate and KMC was signed by Mayor Karachi Barrister Murtaza Wahab and the Consul General Yang Yundong.

He appreciated KMC on the establishment of Pakistan China Friendship Park. Such initiatives are bringing the two countries closer, cooperation between Pakistan and China is already ongoing in many fields and various institutions have been established in Pakistan in this regard.

Yundong said that the citizens of Karachi will get better facilities in their daily life, the Chinese government will continue to cooperate with KMC in this regard.

Mayor Karachi said that Pakistan-China friendship reached heights during the era of Shaheed Zulfiqar Ali Bhutto and after Shaheed Zulfiqar Ali Bhutto, Shaheed Ms. Benazir Bhutto, Asif Ali Zardari and now Bilawal Bhutto Zardari furthered this eternal friendship.

He said the Pakistan-China Economic Corridor has become an important milestone for Pakistan. Thanking the Government of China for helping to stabilize the economy of Pakistan and providing employment to the people here through this very important economic corridor project which is a game changer in the region, there could be no better example of the deep friendship between the two countries.

Murtaza Wahab said Pak-China Friendship Park will further strengthen the bond of friendship between the two brotherly countries, people visiting this park will be grateful to the Chinese government.

Solangi rules out any change or extension in election date

ISLAMABAD, Dec 13 (APP): Caretaker Minister for Information, Broadcasting and Parliamentary Affairs Murtaza Solangi on Wednesday ruled out any change, amendment or extension in the polls date announced by the Election Commission of Pakistan (ECP).

“No extension, amendment or change in the election date given by the Election Commission is on the agenda,” Murtaza Solangi said while addressing a news conference along with the health and IT (information technology) ministers after a meeting of the Federal Cabinet.

The cabinet meeting was presided over by Caretaker Prime Minister Anwaar-ul-Haq Kakar.

The information minister said, “So far, no such incident has occurred which leads to the postponement of the elections.”

Sharing the decisions of the Federal Cabinet, he said the forum had rejected the “unilateral verdict” of the Indian Supreme Court regarding the illegal annexation of Jammu and Kashmir by India as an illegal decision.

“Jammu and Kashmir is not an internal issue of India rather an international dispute that has been an unresolved agenda at the UN Security Council for over seven decades,” he said, adding the so-called decision of the Indian SC would not have any impact on the Kashmir issue.

Solangi said the Federal Cabinet called upon on the international community to strongly condemn the illegal Indian move that usurped the rights of Kashmiris.

He said that the Indian Supreme Court committed a flagrant violation of India’s international commitments and obligations by unilaterally dismissing the petitions against its illegal action of August 5, 2019.

“We believed that the so-called decision will give boost to our efforts for the legitimate solution of the Kashmir issue,” the minister said while quoting the prime minister as saying.

He said the Kashmir issue should be decided according to the resolutions of the United Nations and as per the aspirations of the Kashmiri people.

The minister said Pakistan would continue to extend political, diplomatic and moral support to the people of Kashmir.

At the outset, the cabinet strongly condemned the D I Khan terrorist attack and prayed Allah Almighty to rest the souls of martyrs in eternal peace and grant courage to the bereaved families to bear the loss with fortitude.

Paying tributes to the martyrs, PM Kakar stated that they were pride of the nation and vowed that the war against terrorism would continue till complete elimination of the scourge.

Minister Solangi said that the cabinet made it clear that such cowardly acts of terrorism could not deter the determination of the Pakistani nation.

While giving details of the cabinet decisions, he said that it gave approval to the Memorandum of Understanding on mutual political exchanges between the Republic of Gambia and the Ministry of Foreign Affairs of Pakistan in the context of Pakistan’s “Engage Africa” policy.

The minister said that the cabinet approved the immediate termination of contract of the managing director of the National Telecommunication Corporation (NTC) for misuse of the authority and directed for disciplinary action against him.

It also gave its consent that Mian Mohammad Shafiq, Chief Executive Engineer, would assume the charge as NTC’s acting managing director till the appointment of new managing director, he added.

The cabinet, he said, also approved changes in the rules and regulations to facilitate the Afghan nationals residing in Pakistan, who neither have any legal proof of entry nor processing fee, and want to leave for a third country.

According to the new rules and regulations, Solangi said, the Afghan nationals, who have to evacuate to a third country and do not have any legal documents or processing fees, would be fined $400 for overstaying in Pakistan instead of $ 800.

The deadline for stay of such Afghan nationals in Pakistan had also been extended from December 31, 2023 to February 29, 2024, he said, adding the fine, after the due date, would be imposed at the rate of $100 per month with a maximum limit of $800.

He said the measures were aimed at encouraging the Afghans residing illegally in Pakistan to obtain legal documents or finalize evacuation agreements as soon as possible in a third country.

Solangi said the cabinet also approved the first “National Space Policy”, under which international companies would be allowed to provide services to customers through Low Orbit Communication Satellite in Pakistan.

He said the policy would not only attract foreign investment but also save valuable foreign exchange.

Under the policy, not only a “Space Regulatory Regime” was being implemented in Pakistan in line with modern international requirements, but funds for research and development had also been arranged in SPARCO, the minister added.

Solangi said that the prime minister appreciated the efforts of the Ministry of Information Technology and Telecom, SPARCO, Ministry of Defence and related institutions to formulate Pakistan’s first space policy.

He said on the recommendation of the Ministry of Maritime Affairs, the cabinet approved the immediate return of the Managing Director of the Korangi Fisheries Harbour Authority to his parent institution and also ordered an investigation into the mismanagement in the institution.

It also gave its approval that Director General Operations Port Qasim Authority, Rear Admiral Shahid Ahmed, should look after the affairs of the above Authority till the appointment of new managing director.

On the recommendation of the Ministry of Health, Solangi said, the cabinet approved the decision to forward the cases of Dow Dental College Karachi, Narowal Medical College, Liaquat Institute of Medical Health Sciences Thatta and Khairpur Meris Medical College to the Pakistan Medical and Dental College for initial approval.

The minister said the cabinet approved the decisions made in the meeting of the Economic Coordination Committee (ECC) on November 23, except the one regarding the increase in the prices of medicines.

The cabinet also issued directives to review the entire system of drugs pricing and regulations to find a comprehensive solution to the problem in the future.

The minister quoted the prime minister as saying that the government wanted the pharma industry to develop, but the interest of the people would come first in terms of prices and quality of medicines.

He said the forum directed the Ministry of Health to give a briefing in the next meeting about amendments in the existing drug policy, which included a detailed review of the regulatory and administrative issues of Drug Regulatory Authority of Pakistan (DRAP).

The cabinet also approved the decisions taken in the meeting of the Cabinet Committee on Legislative Cases (CCLC) on December 6.
These decisions included the establishment of National Cybercrime Investigation Agency for the prevention, prosecution and adjudication of cybercrimes, as well as a Telecom Tribunal.

The gave it approval for the decisions taken in the meeting of the Cabinet Committee on Energy (CCoE) on November 22, Solangi added.

Replying to the questions of media persons, Murtaza Solangi said so far no court or constitutional body of Pakistan had declared the current caretaker government illegal.

The Federal Cabinet reviewed the incidents of terrorism in detail, he said, adding that the Ministry of Interior was releasing the data related to the return of illegal immigrants to their homeland.

He said that about 450,000 people had gone back to their native country, the majority of them returned voluntarily.

He said that the government had taken strict notice of the Dera Ismail Khan incident. The prime minister himself went to Dera Ismail Khan as “we are taking this matter seriously”.

“We will go to any extent to protect the people of Pakistan from terrorism,” Murtaza Solangi assured the media.

Regarding Maulana Fazlur Rehman, he said the interior minister had explained that he received threats and it was responsibility of the caretaker setup to provide security to him.

“Kashmir is an international dispute that India itself took to the United Nations Security Council. There are several UNSC resolutions on the Occupied Kashmir,” Solangi said while responding to another query.

To another question, he said that the Palestinian people had been fighting for their right to self-determination for the last 75 years.

ISLAMABAD, Dec 13 (APP):Dense fog is likely to persist in few plain areas of Punjab during the next 24 hours reducing the visibility level, according to the Pakistan Meteorological Department (PMD)’ s forecast.
Fog/smog is also likely to persist in upper Sindh, plain areas of Punjab and Khyber Pakhtunkhwa during morning and night hours.
According to the synoptic situation, continental air was prevailing over most parts of the country. A westerly wave was likely to affect western parts of Balochistan on Thursday.
Mainly cold and dry weather is expected in most plain areas of the country, while partly cloudy in western districts.
Cloudy weather is expected in northwestern districts of Balochistan with rain-thunderstorm may occur in Gwadar, Chaghi, Turbat and surrounding during the period.
During the last 24 hours, cold and dry weather prevailed over most parts of the country, while very cold in northern areas.
The lowest minimum temperatures recorded were Leh -12 C, Skardu -07, Gupis, Kalam, Kalat, Srinagar -05, Dir and Quetta -03C.

Govt. spending hefty amount on health sector to benefit people: Governor

PESHAWAR, Dec 13 (APP): Governor Khyber Pakhtunkhwa, Haji Ghulam Ali Wednesday said the government was spending a hefty amount to improve the healthcare system for the facilitation and benefit of the masses.

He was addressing the convocation of Rehman Medical College as a Chief Guest. The ceremony was also attended by Caretaker Health Minister, Qasim Jan, Health Advisor, Dr Riaz Anwar, Vice Chancellor Khyber Medical University, Dr Zia-ul-Haq, Chairman RMI, Dr Muhammad Rehman, faculty members, and students.

He said that a maximum portion of the budget was being spent on health as the government must ensure the provision of health facilities to people.

Governor lauded the position of RMI in the medical field and said that the medical profession is being given due respect by society and doctors must work for maximum relief of ailing community adding dedication and attitude of doctors is of supreme importance for patients and their recovery.

He advised doctors to be more polite and cooperative and listen to the ordeal of their patients with patience. He also urged doctors to venture into the field of research and innovation for the benefit of patients. He also distributed degrees and commendation certificates among students and congratulated parents for the success of their children.

Later, the Governor met with a delegation of the All Pakistan Marble Industries Association that was led by Asghar Khan Utmankhel. The delegation informed the governor about their problems relating to mining material, under-construction roads in Mohmand district, and granite and marble mining.

Election officials’ training to conclude on Saturday

ISLAMABAD, Dec 13 (APP):The current nationwide training of District Returning Officers (DROs) and Returning Officers (ROs) aims to equip them with essential skills for the effective conduct of elections and will continue until Saturday.
An ECP spokesperson stated that a total of 40 training sessions are planned concurrently, with the goal of enhancing the performance of 142 ROs and 859 DROs.
The extensive training for the newly appointed District Returning Officers (DROs) and Returning Officers (ROs) commenced on Wednesday, December 13, 2023.
Senior Election Commission officers were conducting training sessions for district returning officers and returning officers, covering election procedures, rules, and other administrative aspects.
