LAHORE, Jun 05 (APP): The Lahore High Court (LHC) has confirmed the interim bail of a man accused by his wife of fraud and criminal breach of trust for allegedly selling a vehicle she had received as part of her dowry.
Justice Tariq Mahmood Bajwa issued a four-page written verdict in the case, upholding the interim bail granted to Muhammad Umair Riaz against surety bonds worth Rs200,000.
According to the judgment, the complainant had registered a criminal case alleging that her husband sold a vehicle entrusted to him. The vehicle was registered in the wife’s name, while the husband was using it.
The petitioner maintained that the case stemmed from family and marital disputes. He informed the court that his wife had already filed a claim in the Family Court seeking the return of dowry articles.
The court observed that the disputed vehicle was already part of the dowry claim pending before the Family Court. The judgment noted that the complainant herself had described the vehicle as a dowry item in the family proceedings but did not disclose the pending family litigation in the FIR.
The court further observed that the vehicle remains registered in the complainant’s name and that the criminal proceedings appeared, prima facie, to be the result of strained marital relations between the spouses.
The judgment stated that the accused had joined the investigation and that no evidence of mala fide intent or dishonest conduct had been placed on record. Consequently, the court confirmed his interim bail and directed him to continue cooperating with the investigation.
