LAHORE, Apr 01 (APP):The Lahore High Court (LHC) on Wednesday commuted the death sentence of convict Rafaqat Ali, awarded in the murder case of his brother-in-law, to life imprisonment, ruling that the prosecution failed to fully prove motive and recovery evidence.
A two-member bench comprising Justice Shehram Sarwar Chaudhry and Justice Jawad Zafar announced the verdict while deciding Rafaqat Ali’s appeal against his conviction.
During proceedings, Additional Prosecutor General Abdul Samad opposed the appeal and argued that the convict had fatally stabbed his wife’s brother Asif Aslam and injured his mother-in-law Naziran Bibi during the attack.
The prosecutor told the court that the case was registered at Batala Colony Police Station on October 26, 2018, adding that eyewitness testimony was available in the case. The injured complainant Naziran Bibi and the convict’s wife also testified against the accused before the trial court.
He further stated that the police investigation, medical evidence and witness statements established the convict’s involvement, and the trial court had awarded capital punishment after examining all evidence and hearing both sides.
The defence counsel sought acquittal, but the court maintained the conviction while reducing the sentence, observing that motive and recovery had not been conclusively established.
