ISLAMABAD, Nov 11 (APP):The Supreme Court of Pakistan has reinstated Frontier Constabulary (FC) official Hassan Afridi, setting aside his dismissal from service on allegations of drug smuggling.
The case was heard by a two-member bench of the Supreme Court headed by Justice Syed Mansoor Ali Shah. Hassan Afridi had challenged his termination, arguing that he was dismissed solely on the basis of an intelligence report without any concrete evidence.
During the hearing, Afridi’s counsel, Umar Farooq Adam, contended that the dismissal was made on the basis of a confidential intelligence report, and no independent or verifiable material was produced to substantiate the allegation.
Justice Mansoor Ali Shah questioned whether there was any credible evidence apart from the intelligence report and observed that such reports alone cannot form the basis of punitive action.
The bench noted that reliance solely on an intelligence report, without supporting evidence or a proper inquiry, fails to meet the standards of fairness and due process.
The court held that since no reliable evidence existed beyond the intelligence report, the dismissal could not be sustained in law. Consequently, the Supreme Court accepted Hassan Afridi’s appeal and ordered his reinstatement in service.
The judgment reinforces the principle that disciplinary action against public servants must be supported by credible evidence and conducted in accordance with due process, not merely based on unverified intelligence inputs.
