SC adjourns hearing of petitions against Super Tax

ISLAMABAD, Oct 15 (APP): The Supreme Court’s constitutional bench on Wednesday adjourned the hearing of petitions related to the super tax until Thursday.
During the proceedings, various taxpayer companies were represented by their counsel, Barrister Farogh Naseem, who presented detailed arguments. He contended that the super tax could only be imposed under Section 6B(A) of the Income Tax Ordinance, where clear provisions already exist. He further argued that a relevant schedule is essential for the imposition of any tax, and no tax can be levied without such a schedule.
Justice Jamal Mandokhail asked, “Which tax year will be counted from July 1, 2021, to June 30, 2022?” He added, “In simple terms, if it says ‘from page one onward,’ do we start reading from page one?” To this, Farogh Naseem replied, “If it states ‘from page one onward,’ then it is read starting from page two.”
Justice Muhammad Ali Mazhar inquired, “When tax can be imposed under the charging section, then what is the issue?” In response, Naseem said that several judicial precedents exist concerning charging sections and insurance companies, and that the law already defines how much tax may be imposed on insurance firms.
Subsequently, the court adjourned further proceedings in the case until Thursday, October 16, at 9:30 a.m.
