ISLAMABAD, Oct 07 (APP): The Supreme Court has held that where the judgments of three courts have gone against a party, the entire case cannot be reopened in review proceedings.
The court dismissed a review petition filed by advocate Ghulam Mustafa Kundwal but withdrew an order imposing a fine of Rs 25,000 on him during the hearing.
During the proceedings, Justice Naeem Akhtar Afghan observed that judgments of three courts had gone against the petitioner and that the Supreme Court had also not allowed reopening the matter in review. “You cannot reopen the entire case now,” he remarked.
Justice Naeem Akhtar Afghan further observed that review petitions were filed against every judgment of the Supreme Court.
During the hearing, a heated exchange also took place between advocate Ghulam Mustafa Kundwal and the judges. The counsel said that he was a senior lawyer and that the court was not listening to him, adding that he still had further arguments to make.
Justice Jamal Mandokhail responded that the court had already heard his arguments.
When Justice Jamal Mandokhail remarked that the fine could be increased if the counsel continued with further arguments, Ghulam Mustafa Kundwal said, “You may impose a fine equal to my entire fee, but please hear me. This is what we still expect from the Supreme Court.”
Justice Jamal Mandokhail expressed regret over the counsel’s conduct, saying he was saddened by his attitude.
The court had imposed a fine of Rs 25,000 on the counsel during the proceedings. However, while dismissing the review petition, it withdrew the order imposing the fine.
