IHC stops CDA from demolishing citizen’s house

The Islamabad High Court (IHC) on Thursday restrained the Capital Development Authority (CDA) from demolishing a citizen’s house or taking any coercive action against him, while seeking comments from the civic body.

ISLAMABAD, Oct 08 (APP): The Islamabad High Court (IHC) on Thursday restrained the Capital Development Authority (CDA) from demolishing a citizen’s house or taking any coercive action against him, while seeking comments from the civic body.
Justice Muhammad Azam Khan issued the interim order on a writ petition filed by citizen Malik Mumtaz Ali Khan and also issued notices to the CDA.
The court sought para-wise comments and a report from the CDA before the next hearing.
The petitioner challenged a notice issued by the CDA regarding his house located in Village Koral, Highway Street.
According to the petitioner, the CDA was carrying out construction of a service road near Koral Chowk and had issued him a notice on October 1, 2026, directing him to remove alleged encroachments within three days.
The CDA had declared a 35-foot-7-inch portion of the property to be in violation of the right of way, according to the petitioner.
The petitioner submitted that he had purchased the property around 20 years ago and constructed the building over a period of 15 years at considerable cost.
He further stated that when the service road was widened around 10 years ago, a distance of 30 feet was left between the house and the road.
The petitioner contended that if additional land was required for further widening of the road, it should be acquired in accordance with the law.
He requested the court to restrain the CDA from unlawfully interfering with his property rights and taking coercive action against him.
The court, while issuing notices to the CDA, restrained it from demolishing the building and taking coercive action against the petitioner.
