IHC schedules hearing against appointment of judge Nasir Javed

ISLAMABAD, Oct 31 (APP): The Islamabad High Court (IHC) on Friday scheduled the hearing of the petition against the appointment of District and Sessions Judge Nasir Javed Rana, who sentenced PTI founder and Bushra Bibi in the 190 million pound NAB case, in the second week of November.
Chief Justice Sardar Sarfraz Dogar remarked that the case will be heard in the second week of November, as he is not feeling well today. During the hearing on the miscellaneous petition of Osama Riaz to schedule the case against the appointment of Judge Nasir Javed Rana for early hearing yesterday, the Chief Justice asked the petitioner’s lawyer Riaz Hanif Rahi what this matter is and is this a 2004 order? On which Riaz Hanif Rahi Advocate took the position that in the Supreme Court’s decision of October 19, 2004, Nasir Javed Rana was declared unfit for judicial service, therefore his appointment as a judge is illegal.
The lawyer said that this matter is related to the case of the late Wahab Al-Khairi Sahib. If he were alive, he would definitely have guarded against this decision, therefore he filed the petition.
Chief Justice Sarfaraz Dogar remarked that he will hear it in the second week of November. Today, I am not feeling well.
The position taken in the petition is that Nasir Javed Rana should be stopped from work and the notification of his appointment should be declared null and void. It has further been said that if he has retired before the decision of the petition, all the privileges and dues obtained after December 14, 2022 should be withdrawn, and he should not be declared entitled to any pension or other benefits.
The court directed that the case be fixed for the second week of November. The hearing was adjourned.
