A division bench of the Islamabad High Court (IHC) on Wednesday issued a short written order, in which it set aside the 2022 judgment of a single bench declaring Pakistan Navy’s Naval Farms and Naval Sailing Club along Rawal Lake illegal.
IHC issues short order regarding Naval Farms, Sailing Club
ISLAMABAD, Sep 09 (APP):A division bench of the Islamabad High Court (IHC) on Wednesday issued a short written order, in which it set aside the 2022 judgment of a single bench declaring Pakistan Navy’s Naval Farms and Naval Sailing Club along Rawal Lake illegal.
Justice Inaam Ameen Minhas and Justice Shahrukh Arjumand allowed the petitions challenging the single-bench judgment, according to a brief written order issued by the court.
In a one-page short order, the court also annulled the decision for demolition of the Naval Sailing Club building.
The division bench further set aside the directions concerning former Chief of Naval Staff Admiral Zafar Mahmood Abbasi, including proceedings for alleged misconduct and criminal action against him.
The Ministry of Defence, former naval chief Zafar Mahmood Abbasi and others had challenged the single-bench judgment before the IHC.
The court also set aside the direction to the Auditor General of Pakistan to assess the loss caused to the national exchequer and recover the amount from the officials found responsible.
The order further annulled the direction declaring illegal the transfer of land for the Naval Farms in the name of the Pakistan Navy Headquarters office.
The single-bench judgment had been passed in 2022 by then IHC Chief Justice Athar Minallah.
The division bench said a detailed judgment explaining the reasons for setting aside the single-bench order would be issued later.
