ISLAMABAD, Jun 08 (APP):The Islamabad High Court (IHC) on Monday issued notices to the Capital Development Authority (CDA) seeking its response in the case pertaining to the collection of entry fee in the New Blue Area, directing that the CDA be made a party to the proceedings.
Justice Arbab Muhammad Tahir heard the petition filed by Advocate Tayyab. Petitioner’s lawyers Hazrat Younis and others appeared before the court.
Advocate Kashif Malik submitted before the court that it is not the MCI but the CDA that is collecting the fee. He stated that the MCI has been made a party while the CDA is not a respondent. The parking fee is being collected under the Parking Regulations 2023 approved by the CDA Board, he argued.
According to the counsel, the said area in New Blue Area is designated for parking under the CDA plan, and the parking fee is being collected on CDA land, not on the service road.
Justice Arbab Muhammad Tahir remarked that the court had not even issued a stay order — why are you getting worried?” The court noted that the CDA directed the MCI, and the MCI is collecting the fee. The court directed the CDA to submit a written response.
Petitioner’s counsel Hazrat Younis requested the court to stop the collection of the fee, stating that it is unknown where the money is going, adding that a private contractor is involved and issuing tickets.
The court sought written responses from the CDA as well and adjourned further hearing of the case until June 29.
