ISLAMABAD, Oct 21 (APP):The Islamabad High Court (IHC) on Tuesday instructed the Naya Pakistan Housing and Development Authority (NPHDA) to restore the salaries of its employees.
The court also instructed the authority’s policy board to submit decision regarding dissolution of institution to court. The court also questioned legality of orders for dismissal of employees of authority.
Justice Arbab Muhammad Tahir heard the case filed by petitioner Owais Malik and others. Petitioner lawyer Muhammad Ramzan Khan Advocate and others appeared in the court.
During hearing of the case, the court inquired from authority’s lawyer that if the dismissal of the employees was a policy decision, then why was this decision not taken from the policy board of the authority.
The petitioner’s lawyer said that all the employees are posted on regular sanctioned posts and have been performing duties in the institution for the last five years.
The lawyer said that the acting chairman dismissed the employees without listening to them and without following the service rules.
He argued that no policy decision has been taken yet regarding the dissolution of the institution or dismissal of the employees. This is also confirmed by the reply submitted by the Cabinet Division to the court, he said.
The lawyer said that the Cabinet Division has made it clear that it has no role in the process of dismissal of the employees. All the employees are working on sanctioned posts and the institution is working on a non-development budget, he contended.
The court adjourned the further hearing of the case.
