IHC gives another opportunity to fed govt for submitting report in Dr. Aafia case

ISLAMABAD, Jul 21 (APP):The Islamabad High Court (IHC) on Monday issued a contempt of court show-cause notice to federal cabinet over non-submission of report in Dr. Aafia Siddiqui case.
Justice Sardar Ijaz Ishaq Khan heard the case related to release and repatriation of Dr. Aafia from a US jail.
During the hearing on the petition filed by Dr. Fauzia Siddiqui, petitioner lawyer Imran Shafiq, Additional Attorney General and others appeared in the court.
Justice Sardar Ijaz Ishaq Khan said that I am issuing a contempt of court notice to every member of the federal cabinet. The case should be scheduled for hearing on the first working day after the holidays.
Later, in a three-page order issued by the Justice Sardar Ijaz Ishaq Khan, the court issued a contempt of court notice to the cabinet members and ordered them to submit a reply within 2 weeks. It was said that the federal government did not submit the reasons to the court despite the court order. The court was left with no option but to issue a contempt of court notice to the federal government, it said.
It said that the delivery of justice by a High Court judge was controlled by a weekly roster maintained by the Chief Justice’s office. This situation is both heartbreaking and humorous at the same time. A contradiction that has now become the hallmark of this High Court.
The court also said that it had given the government an opportunity to present its decision. It had warned the Additional Attorney General that if the report was not submitted, contempt of court proceedings would have to be initiated. The government filed an appeal in the Supreme Court against the order for permitting an amendment in petition of Dr. Fauzia.
Justice Ishaq wrote that if a judge wants to set up a court to deliver justice, the High Court administration will not allow him during the vacation.
