ISLAMABAD, Jul 22 (APP):The Islamabad High Court (IHC) on Tuesday disposed of a petition as withdrawn by an oversea Pakistani seeking protective bail in a case.
Justice Khadim Hussain Soomro, hearing the case, also expressed astonishment at the absence of objection from the Registrar’s Office on protective bail plea of Tariq Aziz, a citizen residing abroad.
The court accepted the petitioner’s request to withdraw the case and disposed it off.
During the hearing, Justice Soomro inquired as to why he was seeking protective bail, what was the case. The petitioner’s lawyer said that there was no copy of the case, a notice was sent by the Anti-Corruption Punjab, the names of the witnesses, accused and plaintiff were also written in the notice, efforts were made to obtain information and a copy of the case but were not found.
Justice Soomro said that if there is no case, how can we grant protective bail? The court cannot establish a tradition that can be misused later. It is surprising that there is no copy or reference of any case with the petition and no objection from any Registrar’s Office. At this time, a request was made by the attorney-appellant to withdraw the petition.
The court disposed of the case after the petition was withdrawn.
