ISLAMABAD, Feb 06 (APP): The Islamabad High Court (IHC) on Friday directed to produce all four children in a family dispute related to the custody of kids.
Justice Mohsin Akhtar Kayani remarked that disputes can occur between husband and wife, but they should not be turned into a fight between parents.
Justice Mohsin Akhtar Kayani heard the application of the mother of the children. During the hearing, the husband and wife appeared in the court along with their respective lawyers. The court directed all the children to be presented in the court at the next hearing and remarked that the children cannot be divided.
During the hearing, the court inquired about the number and ages of the children, to which the lawyer of the petitioner said that there are four children aged between 12 and a half years and 4 and a half years, including two sons and two daughters. One younger son is with the woman, while three children are with the father.
When the court asked the couple about the separation, both of them stated that neither they have separated nor do they want to separate, to which the court remarked that if there is no separation, then what is the reason for living apart for four years? The husband took a stand in the court that he neither wanted separation nor remarried, however, the wife demands that the house be transferred to her name.
To this, Justice Mohsin Akhtar Kayani said that transferring the house to the wife’s name is not a big deal, he has also transferred his property to his wife’s name.
The court remarked that judges and lawyers are enemies of husband and wife and children because they cannot resolve the matter that the husband and wife can resolve between themselves. The court directed the parties to sit down and resolve the matter, learn to apologize and forgive, if one gets angry, the other should show patience.
The court said that it is the courage of a woman to leave her parents and live with her husband and this is a critical time for the upbringing of children, because in a few years the children will grow up and both the parents may have to bear the consequences of this situation.
Upon court inquiry, both the husband and wife agreed to apologize to each other, upon which the court directed them to sit together in the courtroom.
The Islamabad High Court ordered the four children to be produced in court at the next hearing and adjourned the hearing of the case till next Friday.
