FCCP suspends disqualification proceedings against MNA Sohail Sultan

ISLAMABAD, Jan 26 (APP):The Federal Constitutional Court of Pakistan (FCCP) has restrained the Election Commission of Pakistan (ECP) from taking any further action in the disqualification case against Member of the National Assembly (MNA) Sohail Sultan from Swat until further orders.
The case was heard by a two-member bench comprising Justice Aamir Farooq and Justice Rozi Khan, which issued notices to the Election Commission and all other concerned parties.
During the hearing, Barrister Gohar appeared on behalf of Sohail Sultan and argued that a writ petition can be filed under Article 199 of the Constitution once the election process is complete. He contended that the Speaker of the National Assembly did not have the legal authority to send the reference in the first place.
Barrister Gohar further cited the Nawaz Sharif disqualification case, stating that the Supreme Court had already laid down clear principles that such references must be sent strictly within a defined constitutional framework.
The court was informed that Sohail Sultan is accused of failing to complete a legally mandated two-year restriction period after being appointed as an assistant advocate, which formed the basis for initiating disqualification proceedings against him.
After hearing the arguments, the Federal Constitutional Court directed the Election Commission to halt all proceedings until further notice, issued formal notices to the parties, and adjourned the hearing to a later date.
