FCCP rules Wheat Quota Policy solely under executive authority

ISLAMABAD, Nov 27 (APP):The Federal Constitutional Court has issued an important ruling regarding the wheat quota policy, declaring that policy formulation falls under the exclusive domain of the executive and that courts cannot interfere in this jurisdiction. The court accepted the Sindh government’s appeal and set aside the Sukkur Bench of the Sindh High Court’s decision dated 31 May 2023.
A three-member bench of the FCCP, headed by Justice Amin-ud-Din Khan, heard the case on Thursday. During the proceedings, Additional Advocate General Sindh, Subtain Mehmood argued that the guidelines issued by the Sindh High Court were not supported by the Constitution and fell outside the court’s jurisdiction.
Additional Attorney General Munawar Duggal also submitted that policy-making and its implementation were the exclusive prerogatives of the executive, and that the judiciary may only examine the legal aspects of such matters. Justice Ali Baqar Najafi remarked that it was always the executive’s responsibility to formulate and announce policies.
The case originated when a flour mill owner approached the Sindh High Court over issues relating to the allocation of wheat quotas, prompting the court to issue certain directions. The Sindh government subsequently challenged the decision.
After hearing arguments from all parties, the Federal Constitutional Court accepted the Sindh government’s appeal and annulled the Sindh High Court’s earlier ruling.
