The Federal Constitutional Court of Pakistan (FCCP) on Thursday declined a request to halt contempt/enforcement proceedings seeking to send the Capital Development Authority (CDA) chairman to jail in a case concerning a plot in the Orchard Scheme and adjourned further hearing of the matter.
FCCP declines to halt contempt proceedings against CDA chairman
ISLAMABAD, Sep 24 (APP): The Federal Constitutional Court of Pakistan (FCCP) on Thursday declined a request to halt contempt/enforcement proceedings seeking to send the Capital Development Authority (CDA) chairman to jail in a case concerning a plot in the Orchard Scheme and adjourned further hearing of the matter.
During the hearing, counsel Qasim Chauhan informed the court that a show-cause notice had already been issued to the CDA chairman in the enforcement proceedings and that the matter was fixed for implementation on September 28.
He requested the court to direct that the enforcement proceedings also be stayed if the FCCP adjourned the main case.
Justice Amir Farooq observed that the case could be fixed for early hearing, noting that one of the parties had sought an adjournment.
In a lighter observation, Justice Farooq remarked that the CDA chairman could even perform his duties from Adiala Jail, saying that the authority could be run while he was in custody.
The judge also expressed the hope that the enforcement court would respect the pendency of the matter before the Federal Constitutional Court.
The court subsequently rejected the request to halt the enforcement proceedings against the CDA chairman and adjourned further hearing of the case.
