ISLAMABAD, Oct 31 (APP):The Supreme Court has restrained the Cantonment Board from issuing property tax notices on Evacuee Trust properties.
The apex court suspended a Peshawar High Court judgment in this regard and issued notice to the Peshawar Cantonment Board. During the hearing, counsel for the Evacuee Trust Property Board, Hafiz Ahsaan Khokhar, argued that all Evacuee Trust properties belong to the federal government; therefore, the Cantonment Board or any other authority has no jurisdiction to levy property tax on them. He submitted that the Constitution clearly states that no institution other than the federal government can impose taxes on federal property.
After hearing arguments from the parties, the Supreme Court suspended the Peshawar High Court’s ruling and issued notice for further proceedings. The case was heard on Friday by a five-member bench of the Supreme Court headed by Justice Aminuddin Khan.
