PESHAWAR, Dec 03 (APP): The Peshawar High Court (PHC) on Wednesday dismissed the petition filed by former Khyber Pakhtunkhwa Chief Minister Ali Amin Gandapur challenging the decision to declare Pakistan Tehreek-e-Insaf (PTI) members of the provincial assembly as independent lawmakers.
The case was heard by a two-member bench comprising Justice Muhammad Naeem Anwar and Justice Kamran Hayat Miankhel.
In his petition, Ali Amin Gandapur had challenged Election Rules 94, arguing that the Election Commission of Pakistan (ECP) had declared PTI-backed candidates as independents and should clarify whether PTI is recognized as a political party or not.
During the hearing, the lawyer representing the Election Commission stated that prior rulings on reserved seats had already been issued by a five-member Peshawar High Court bench and later upheld by the Supreme Court.
Meanwhile, the counsel for Pakistan Muslim League-N (PML-N) argued that the constitutional bench had already decided the review petitions, and the matter now stands concluded.
After hearing all arguments, the court had reserved its verdict earlier, which was announced today. The PHC formally rejected the petition of the former chief minister.
