PHC allows KP Governor to use Nathia Gali Governor House

PESHAWAR, Jul 30 (APP):The Peshawar High Court (PHC) on Wednesday allowed Governor Khyber Pakhtunkhwa Faisal Karim Kundi to use the Governor House Nathia Gali and issued notices to the provincial government in response to a petition filed against the transfer of the property to the provincial administration.
The bench comprising Justice Ejaz Anwar and Justice Dr. Khurshid Iqbal heard the petition filed by advocate Shumail Ahmad Butt, who argued that the provincial government had unlawfully taken the Governor House Nathia Gali into its control and intended to use it for commercial purposes.
The petitioner maintained that the constitutional status of the Governor House can only be altered through a presidential order.
He cited the example of the Governor House in Murree, Punjab, where a presidential notification was issued for its change in status.
Shumail Butt contended that the KP government acted beyond its jurisdiction by changing the use and control of the Nathia Gali Governor House without following the proper constitutional process.
After hearing the initial arguments, the court permitted Governor Faisal Karim Kundi to continue using the Nathia Gali Governor House and sought a reply from the provincial government. The hearing was adjourned until a later date.
