LAHORE, Dec 31 (APP): The Lahore High Court (LHC) on Wednesday referred more than ten petitions challenging proceedings initiated under the Property Ownership Act to a full bench, observing that the Act has already been suspended and any further action in this regard can only be taken by the full bench.
Justice Abhar Gul Khan heard the petitions filed by Younas Rana and others.
During the hearing, counsel for the petitioners, including Hafizullah Yar Sapra, contended that despite clear court orders, District Resolution Committees (DRCs) in several districts were still facilitating the handing over of property possession. The counsel informed the court that in Chiniot, the deputy commissioner had verbally summoned the parties at noon to deliver possession of a two-kanal property, while similar actions were also underway in Nankana Sahib.
Justice Abhar Gul Khan remarked that the Chief Justice has suspended the Act and stayed the implementation of all actions taken under it, adding that all related cases would be heard by the full bench.
Advocate Azhar Siddique argued that his petition was different from the others as he had directly challenged the vires of the Act. However, the court observed that all matters, without exception, would be placed before the full bench.
The petitioners’ counsel requested the court to refer the cases to the full bench while also issuing a special notice to the Advocate General Punjab. The court stated that it would consider the request and subsequently referred all the petitions to the full bench for further proceedings.
