NCCIA file appeal in the SC to withdraw order in Iman Mazari case

ISLAMABAD, Jun 01 (APP):The National Cyber Crime Investigation Agency (NCCIA) has filed an application in the Supreme Court seeking withdrawal of its May 12 order in the case relating to the suspension of sentences awarded to lawyers Imaan Mazari and Hadi Chattha.

In its petition, the NCCIA contended that the Supreme Court cannot interfere in matters that are already pending before a High Court.

The application stated that in its May 12 order, the apex court had issued certain directions to the High Court, whereas the authority to decide an application for suspension of sentence rests with the concerned High Court, which is required to hear all parties and decide the matter in accordance with law.

The NCCIA argued that, in keeping with the principle of equal treatment, the Supreme Court should withdraw its said order. It maintained that Imaan Mazari and Hadi Chattha are not entitled to any special concession or preferential treatment merely because they are members of the legal fraternity.

According to the applicant, a party cannot directly approach the Supreme Court against a High Court’s decision to issue notice to the opposing side for hearing.

The NCCIA requested the apex court to recall its order dated May 12, 2026, so that the matter may proceed before the relevant High Court in accordance with the law.

It may be recalled that the case concerning the suspension of sentences of Imaan Mazari and Hadi Chattha is currently pending before the High Court, while the NCCIA has already filed a review petition before the Supreme Court against its earlier order.
