ISLAMABAD, Mar 09 (APP):The Supreme Court on Monday strongly reprimanded an accused during the hearing of his pre-arrest bail petition in a brawl case and directed the parties to make efforts for reconciliation.
A three-member bench headed by Justice Hashim Kakar heard the case.
During the hearing, counsel for the complainant submitted that the accused had struck the complainant with an iron rod during a fight, breaking his knee.
The lawyer further informed the court that the accused was also involved in 18 other cases related to fighting and violence.
During the proceedings, Justice Hashim Kakar expressed displeasure over the behaviour of the accused in the courtroom, remarking that his attitude did not appear appropriate.
He questioned the accused’s conduct, asking whether he considered himself a troublemaker and why he was unable to stand properly in court. The judge further asked who he thought he was to go around breaking people’s legs.
The court observed that if reconciliation was not reached between the parties, the dispute could escalate into more serious violence, even leading to killings. Justice Hashim Kakar remarked that people from Khushab do not easily forget such fights.
At this point, Justice Ishtiaq Ibrahim asked the complainant, Umar Draz, whether he was willing to reach a settlement. The complainant replied that he had suffered injustice and would not forgive the accused, insisting that the latter should be punished.
According to the complainant, despite breaking his knee, the accused continued to threaten and intimidate him.
Justice Ishtiaq Ibrahim observed that some people forgive even incidents of murder for the sake of Allah. Justice Hashim Kakar added that the court would put an end to the accused’s acts of hooliganism.
The court remarked that reconciliation would not be possible in this manner and indicated that a fine would be imposed on the accused. The court also warned that if the parties failed to reach a settlement by the next hearing, the consequences could be serious.
Later, the court adjourned further hearing of the case until April 2.
