ISLAMABAD, Mar 03 (APP):The Islamabad High Court (IHC) issued a notice to the Secretary Khyber Pakhtunkhwa (KP) Home Department on a petition to bring back the accused from Saudi Arabia in a murder case and sought the case record.
The court has directed that the KP authorities concerned provide the record of bringing back the accused from Saudi Arabia to the authorities.
Hearing a murder case in Swat, Justice Mohsin Akhtar Kayani, made important remarks on the failure to produce the accused in eight years and bring them back from Saudi Arabia, saying that now there was a war going on, even under normal circumstances, the government was not able to bring the person back from Saudi Arabia through interpol.
The murder was committed in 2018 after which both accused escaped to Saudi Arabia. Both are fugitives.
The court noted that a petition was filed here in 2023 to bring back the accused bur still they were not able to bring the two men back from Saudi Arabia.
Justice Mohsin Akhtar Kayani inquired that whether these two men had any special status. saying “Who are these people? Omar Bacha and Hakim Khan. Are they a politician or someone from the royal family?”
To which the Assistant Attorney General said that both the accused work on daily wages. The court remarked that what should the poor person do whose beloved had been murdered.
The court said that these are the circumstances due to which crime increases and people start taking the law into their own hands.
Foreign Ministry officials said that the KP government has not yet provided the relevant records. The court ordered that a notice be issued to the Secretary of the Khyber Pakhtunkhwa Home Department, directing him to provide the records to the authorities related to bringing the accused back from Saudi Arabia. The court adjourned the further hearing of the case till May, 2026.
