SC Shariat Appellate Bench upholds additional qualification requirement for promotions

ISLAMABAD, Mar 02 (APP):The Shariat Appellate Bench of the Supreme Court of Pakistan on Monday dismissed an appeal challenging the requirement of additional qualifications for promotion in public and semi-public institutions, declaring that such a condition was not contrary to Shariah.
A five-member bench headed by Justice Jamal Khan Mandokhail heard the case. During the proceedings, the court observed that imposing a condition of additional educational or professional qualifications for promotion dd not violate Islamic principles.
Justice Mandokhail remarked that the requirement is fully in line with Islam, as adherence to merit and competence is a fundamental requirement of justice.
During the hearing, Additional Attorney General Munawar Gul submitted that Islam encourages advancement based on capability and competence, and that setting standards within institutions is essential for improvement.
He argued that the condition of additional qualifications enhances institutional performance and does not amount to discrimination in any sense.
After hearing the arguments, the court dismissed the appeal, upheld the relevant judgment, and ruled that the requirement of additional qualifications for promotion is not repugnant to Shariah.
