ISLAMABAD, Feb 26 (APP):The Federal Constitutional Court of Pakistan on Tuesday issued a notice to the Water and Power Development Authority (WAPDA) in a case concerning the transfer of its medical officer, Dr Tariq Memon, and sought a detailed response at the next hearing.
During the proceedings, Justice Hasan Azhar Rizvi observed that Dr. Memon appeared to be highly educated and well qualified. The court noted that no allegations of corruption, negligence, or misconduct had surfaced against the doctor.
Justice Rizvi questioned whether the transfer from Hyderabad to Chitral was intended as a punitive measure. He pointed out that the hospital in Hyderabad has 80 beds, whereas the facility in Chitral comprises only 18 beds.
The judge further remarked on whether the doctor was being sent to a remote area without justification, asking rhetorically if there was any reason other than administrative grounds for the transfer.
During the hearing, the Additional Attorney General raised a legal question regarding maintainability, arguing that Dr Memon could have approached the High Court directly. He contended that, against a departmental action, the appropriate forum for the doctor was the Service Tribunal.
The court directed WAPDA to submit a comprehensive reply addressing the legal and factual issues at the next date of hearing.
