ABBOTTABAD, Feb 23 (APP):The Peshawar High Court (PHC) Abbottabad Bench Monday has rejected the post-arrest bail application of the accused in the high-profile dumper accident case involving schoolchildren.
The bail petition, titled Mohsin versus State, was heard by Justice Aurangzeb. After hearing detailed arguments from both sides and examining the record, the court dismissed the bail application, observing that at the present stage, the accused does not deserve the concession of bail.
During the hearing, the complainant counsel, Kiran Ayub Tanoli, Advocate Supreme Court, strongly opposed the bail plea. She argued that the accused was directly involved in the incident and sufficient material on record links him to the offence. She further stated that the case does not fall within the scope of further inquiry.
The counsel also informed the court that the accused did not possess either an HTV or LTV driving license to operate the dumper and had entered the area during prohibited hours, particularly school timings, which reflects serious negligence and recklessness. She emphasized that the gravity of the offence is heightened as innocent schoolchildren were among the victims.
The defence counsel, Nasir Tanoli, Advocate High Court, presented arguments in support of the bail application and requested the court to grant relief to the accused.
The tragic dumper accident in Abbottabad had claimed the lives of innocent schoolchildren and sparked widespread public concern. After hearing the arguments and reviewing the evidence, the court ruled that the accused is not entitled to bail at this stage and rejected the application accordingly.
