ISLAMABAD, Dec 31 (APP): The Islamabad High Court (IHC) on Wednesday sent a matter to the Director Federal Investigation Agency (FIA) regarding the forcible offloading of the citizen from a flight of Azerbaijan, and disposed of the case.
The case of a citizen allegedly being offloaded from a flight to Azerbaijan has reached the court.
The court said that the DG FIA should take action on this request as per the law and submit a report.
Justice Arbab Muhammad Tahir issued a written order regarding hearing on a petition of citizen Ehteshamul Haq.
The court said that according to the petitioner, he was forcibly offloaded from a flight to Azerbaijan. The petitioner has requested to declare the offloading as illegal, it said.
It said that the petitioner has requested to remove the stamp of offloading from the passport and related records. The order said that the petitioner also requested to pay damages and an independent inquiry into the allegations of demanding bribes.
The court said that in response, the FIA denied offloading, bribery and other allegations. The FIA said that if the applicant provides evidence, an impartial inquiry will be conducted.
According to the applicant, the FIA staff stationed at the Islamabad International Airport stopped him and he was illegally offloaded without giving any reason.
The applicant has attached a copy of his passport with the application, on which the offload stamp is affixed, the court noted.
The petitioner alleged that the staff also demanded a bribe of Rs 80,000. According to the petitioner, he was asked to leave for his destination on payment of the amount.
The court said that the allegations made by the petitioner are serious in nature. The record shows that no application was made to the DG FIA before approaching the court.
The order said that the petitioner is required to satisfy that the matter was first placed before the concerned officer.
According to the record, no application was made to the DG FIA for inquiry in this regard.
It said that due to serious allegations, this application should be considered pending before the DG FIA. DG FIA should conduct an inquiry as per the law and submit a report.
The court ordered to send a certified copy of the court order to the DG FIA. It disposed of the case with instructions.
