IHC directs Finance Ministry to issue pension to ex-auditor general

ISLAMABAD, Dec 02 (APP):The Islamabad High Court (IHC) on Tuesday directed the Ministry of Finance to issue pension to former auditor general of Pakistan Akhtar Buland Rana as per the court orders.
Justice Mohsin Akhtar Kayani heard the contempt of court case filed by Akhtar Buland Rana for non-payment of pension despite court order. Advocate Taimur Aslam appeared in court on behalf of the petitioner.
The court ordered the ministry to come up after preparing the pension sheet and tell how much money is payable and when will it be paid. Joint Secretary Finance Division said that we have nothing to do with this case, we only issue policy guidelines to the relevant department.
Justice Kayani said that this is a matter of pension of a general government employee, how will this payment be made. When a person retires from any department, the pension has to be issued by his/her respective department, the court said.
The court instructed the ministry to pay the dues to the civil servant. Justice Kayani remarked that I do not want to issue arrest warrants for the Accountant General and Auditor General.
He said that I do not want to use the power of contempt of court so that any loss occurs to the public servant. The court will summon both of them in a personal capacity and make them understand, he remarked.
Justice Mohsin Akhtar said that if there is an order, whether you agree with it or not, it has to be implemented. The court order has not been suspended yet nor has it been annulled by any court, he observed.
Justice Kayani said that you could not get the court order suspended by filing your case in eight months. You should request the Attorney General and the government to get the order suspended from the division bench or the Federal Constitutional Court or follow the court order, he said.
The court said that even if he is removed for misconduct during re-appointment to a post after retirement, the previous pension will not be affected.
The court issued instructions and adjourned the hearing of the case until December 12.
