ISLAMABAD, Nov 27 (APP):The Lahore High Court Bar Association has formally filed a petition in the Federal Constitutional Court, requesting that the ongoing case concerning military courts be transferred back to the Supreme Court.
According to the petitioner, judicial jurisdiction and judicial powers are two distinct concepts, and the authority to interpret constitutional amendments and core constitutional issues rests solely with the Supreme Court.
The petition further argued that the case pertaining to military courts does not fall under Articles 175-E and 175-F of the Constitution. Hence, the Federal Constitutional Court is not authorized to hear such matters. The petitioner maintained that the Constitutional Court may only adjudicate cases arising from decisions made under Article 175-E.
The Lahore Bar Association has requested the court to send the matter of military courts back to the Supreme Court so that it may adjudicate this significant constitutional dispute.
