ISLAMABAD, Nov 24 (APP):The Federal Constitutional Court on Monday heard the case relating to the appointment of the Rector of the International Islamic University.
During the proceedings, the university’s counsel informed the court that the position of rector was currently vacant because the chairman of the Higher Education Commission — who had been given additional charge as interim Rector— had retired from office.
He added that the authority to make a permanent appointment rested with the President of Pakistan in his capacity as Chancellor of the university.
The counsel argued that the court lacked jurisdiction to hear intra-court appeals in the matter, as the appeals had been filed under the Supreme Court (Practice and Procedure) Act.
Chief Justice Ameen ud Din Khan asked the counsel on what basis he challenged the court’s jurisdiction. The counsel replied that Article 184(3) had been abolished through the 27th Constitutional Amendment, which, he said, had changed the appellate forum for such matters. He added that the appeals in question had been filed before the amendment came into effect.
Justice Ali Baqar Najafi observed that if there was an objection, a separate application regarding jurisdiction could be filed.
After hearing arguments from both sides, the court adjourned the case indefinitely.
