PESHAWAR, Oct 13 (APP):The joint opposition here Monday declared the election of the Chief Minister of Khyber Pakhtunkhwa unconstitutional and has announced plans to challenge it in court.
Meanwhile, the Governor of Khyber Pakhtunkhwa, Faisal Karim Kundi, has also raised concerns, saying that how can the election of a Chief Minister take place before Ali Amin Gandapur’s resignation is accepted?”
He further said that he was not satisfied with Ali Amin Gandapur’s resignation and he should come to me on Wednesday regarding confirmation of his resignation.
The Governor said that until the resignation is officially accepted, the election of a new Chief Minister will be considered unconstitutional.

Earlier, the Governor had objected to Ali Amin Gandapur’s resignation, saying that his office received two copies of the resignation, and the signatures on them do not match.
On the other hand, the opposition leader in the Khyber Pakhtunkhwa Assembly, Dr. Ibadullah, said that the opposition will go to court tomorrow against the Chief Minister’s election.
“Until yesterday, we believed the resignation had been accepted, which is why candidates submitted nomination papers. Today we found out that the resignation hasn’t actually been accepted yet.”
Dr. Ibadullah added that in this uncertain situation, where Ali Amin Gandapur’s resignation has not been accepted, the election of the Chief Minister is unconstitutional. “Their lawyers are saying it’s fine and we are saying it is wrong.”
Sohail Afridi has been elected as the new Chief Minister of Khyber Pakhtunkhwa, while the opposition staged a walkout from the assembly, citing the election process is illegal and unconstitutional.
